Disparate Impact Disparate Treatment in the Workplace - Workology
Disparate Impact Disparate Treatment in the Workplace - Workology Disparate Impact Disparate Treatment in the Workplace In Social Media Recruiting Social Media Discrimination I outlined some of the types of protected classes and discussed some real world possible scenarios regarding your company and social media discrimination. In EEOC Workplace Discrimination, I outlined potential liabilities and government agencies that are learning about social media. Now in part three, Iâll be discussing disparate impact and disparate treatment in the workplace. Disparate Impact Disparate Treatment in the Workplace Social media is a goldmine for government agencies looking to turn their departments into revenue generating machines. In 2010, OSHA added 100 additional field investigators focusing on enforcement and their sites set on lofty revenue goals of $559 million. In 2011, it is estimated the government agency will add an additional 25-50 compliance officers. I believe the same holds true for agencies like the EEOC. It is only a matter of time before they seize the income opportunity that social media and social media discrimination brings. As pointed out by Stephanie Thomas (a Blogging4Jobs reader), social media also raises additional areas for discrimination in disparate treatment and disparate impact. Stephanie says, âThe use of social media in recruiting raises two potential areas for discrimination: disparate treatment and disparate impact. Disparate treatment is what we usually think of when discussing discrimination â" itâs intentionally treating people differently because of gender, race, age, disability, etc.â Disparate Treatment Discrimination Disparate treatment is defined as when an individual of a protected group is shown to have been singled out and treated less favorably than others similarly situated on the basis of an impermissible criterion under Title VII. The issue is whether the employerâs actions were motivated by discriminatory intent. Discriminatory intent can either be shown by direct evidence, or through indirect or circumstantial evidence. Disparate Impact Discrimination Disparate impact is defined as when an employment practice may be considered discriminatory and illegal if they have a disproportionate âadverse impactâ on members of a minority group. Under the doctrine, a violation of Title VII of the 1964 Civil Rights Act may be proven by showing that an employment practice or policy has a disproportionately adverse effect on members of the protected class as compared with non-members of the protected class. So what does this mean for social media discrimination? Social Media, Disparate Treatment Disparate Impact Stephanie (who commented on my earlier articles on social media discrimination) says, âUsing social media in recruiting and hiring has the potential to create both disparate treatment and disparate impact. However, if a few simple steps are followed, social media can be used to recruit and hire individuals safely and effectively.â When job applicants fill out employment applications, they are not supposed to be asked questions that might reveal what I call the Big 7 (age, sex, religion, disability, race/color, national origin, pregnancy and most recently added genetic information), however companies who use social media have access to this information. Rather quickly (as a recruiter) I can learn from a blog post or a Facebook profile about a candidateâs religious preferences and their age. This could be considered disparate treatment if and when I seek out protected information on social media sites for one candidate or employee but not for others. A disparate impact is a concern if recruiters and companies exclusively use social media to source and search for candidates. For example, if a recruiter relies solely on Twitter to advertise job openings, they are reaching a predominantly Caucasian audience. Quantcastâs most recent data tells us that Twitter is comprised of 69% Caucasian, 16% African American, 3 % Asian, and 11% Hispanic. This audience is also an audience with a large percentage under 40 years of age. Thirty-eight percent of Twitterâs users are between the ages of 34-50 +. Since over two thirds of Twitter users are engaging using mobile devices, companies could possibly being singling out others as well. Edision Research conducted a very thorough Twitter in America Study in 2010. Those candidate pools without access to smart phones and mobile devices who quite possibly could be minorities would be excluded for further job opportunities if relying to advertise openings and source candidates on a single platform. How to Avoid These Situations of Adverse Impact The key is through clear communication to your recruiting and human resource teams while having a solid process in place. Companies must continue to advertise openings in a variety of ways to reach the widest audience without causing discrimination. Job boards, newspapers, magazines, and career fairs should continue to be leveraged in addition to social media to reach an audience representative of the community in where the position is located. From SEO to social and email to guide, it envelops such a significant number of various angles that naming yourself as an 'independent advertiser' may really set you out as a handyman, yet an ace of none. What's more, in such a serious market evalThe first activity is to discover which organizations are in a situation to take on a consultant like you. On the off chance that you're determined to working in a particular industry, at that point do a snappy computerized review of some nearby organizations in that industry; examine their online networking endeavors, their inquiry positioning, their email promoting program our option is to rather take a gander at the master plan. At this point you ought to have a respectable thought of which territories these organizations are commonly ailing in, so tailor your independent contribution around that. So if your examination proposed that online life appears as though a regularly ignored zone, begin considerin g the administrations you could give as an independent network chief and how you could profit companies. After all, in my estimation firms are bound to go for a pro to deal with their internet based life than the 'handyman we referenced in the opening paragraph.Work Out How Much You're Wortha) Starting OutWhen I previously went independent in 2015, this was one of the most testing parts of the transition.I thought that it was extremely hard to decide what I was worth to organizations constantly, especially as I possessed just worked full-energy for 2.5 years after college before going it alone.evalI still felt fairly unpracticed in the business and unquestionably couldn't yet legitimize a high hourly rate, however then again I would not like to underestimate myself and not procure enough to live on.In the end, I began looking at different consultants in my neighborhood see the kind of rates that they were charging. While most didn't distribute their rates on their site c) Marketing Y ourselfIt's one thing to have the option to pick up presentation for your customers â" however in the event that you can't do likewise for yourself, at that point they'll always be unable to discover you in the first place. If you're not an inside and out promoting master with skill in all zones, I would particularly suggest reviewing the nuts and bolts of web-based social networking advertising, SEO, email showcasing and web composition to give yourself the most obvious opportunity with regards to being found by new clients.evalFortunately, as a planned independent advertiser, you should as of now be very knowledgeable in picking up introduction â" I trust! So this shouldn't be a significant challenge. It's increasingly an instance of finding the hours in seven days to refresh your site, compose a blog, check your inquiry positioning, update your online networking profiles, convey a promoting email just as dealing with your accounts, pursuing receipt installment and doing your genu ine activity in advertising. Which brings us pleasantly onto my next point⦠b) Managing Your TimeOne bit of guidance that I read before beginning has ended up being one of the most useful.Don't take on a lot of work! On the off chance that you're sufficiently fortunate to be overflowed with enquiries, at that point it tends to be enticing to take on however much work as could reasonably be expected â" all things considered, it won't keep going forever. Once in a while customer work can overwhelm and you'll end up without enough hours in the week to accomplish your work. Also, that implies the nature of the work for every customer will endure, which is certifiably not a hint of something better over the horizon for keeping up a drawn out organization with them.evalAlso, not having sufficient opportunity to manage your own financeswill seriously sway you sometime later and make that expense form a considerably greater migraine than previously. Not having whenever to advertise yourself will hit you hard as well, supposing that your present stir evaporates then you won't be in a situation to source some more as fast as you would like.To cure this, actually I've never 'maximized' my time at what all day working hours would be.I've in every case left myself a touch of breathing space to stay aware of these fundamental assignments, and furthermore to give myself the alternative of working with another customer just on the off chance that a truly energizing open door comes up. It's very little fun turning down somebody you couldn't want anything more than to work with!Whilst it might be hard to turn down work when you have the ability t o take it on, having the option to chip away at ventures you're increasingly enthusiastic about is a reasonable long haul choice for your outsourcing career.SummaryBecoming an independent advertiser is no simple errand in such a serious industry. It's critical to have the option to separate yourself from the opposition by distinguishing the advertising disciplines that are generally missing among organizations in your industry or area. Then it's an instance of utilizing your present abilities to showcase yourself similarly just as you're ready to advertise other companies.By accepting these tips and exceeding expectations in the foundations of specialist achievement: time the board, budgetary administration and self-restraint, you'll be well en route to a long and sound profession as an independently employed advertiser.

Job Adverts How To Attract The Perfect Candidate (And Repel The Random Ones!)
Job Adverts How To Attract The Perfect Candidate (And Repel The Random Ones!) If youre on the look-out for new employees at the moment, it goes without saying that when it comes to applications, youre going to be looking for quality over quantity. Dont agree? Well, lets think about it for a second. Yes, lots of job applications would be nice because then youve got plenty of choice but what about if none of them are really relevant? Do you really want to go for a catch-all advert and then receive and sort through hundreds of applications only to find yourself back at square one when none of them really hit the mark? I didnt think so. Now weve got that cleared up, its time to look at how you actually attract those quality applications to your vacancy and company in general and as youve probably guessed OK, so weve covered job adverts more than a couple of times on this blog, namely the mistakes to avoid, how to make your company stand out from the crowd and the top tips for writing great job adverts but weve never actually talked about how you can tailor your ad to attract only the most relevant candidates from the off until today. So without further ado, lets look at the top five things you can do to your job advert to attract the perfect candidate and repel the random ones! 1. Include As Much Detail As Possible If youre looking for someone very, very specific to fill your role, you need to make sure the advert reflects this. Be sure to include as much detail as possible regarding the actual job role, the responsibilities involved and the type of experience youre looking for in the candidate. The more vague you leave things, the more room there is for interpretation from the candidate and the more likely youll receive applications which dont fit the bill. Also, dont be afraid to say you only want to hear from candidates that can hit the mark on 80-100% of the requirements. OK, so the candidates that apply for any and every job going might still ignore this (just as they ignore all screening questions) but theres a chance that those that are sitting on the fence wont ignore it and will be put off applying so you could end up with 90% relevant and 10% random applications not a bad ratio huh? 2. Show Some Personality If youre a brand with a big personality and a clear voice, you need to make sure you show it. If you can create a job advert which has a clear brand voice and which accurately reflects your company and its values, the more likely you are to attract candidates that are right for your company. Think about it there are going to candidates out there that get you and your brand, and there are going to be others that just dont and just wouldnt fit in. The sooner you can communicate your brand and your voice, the sooner you can find the right candidates! 3. Clarify The Location/Salary If youre based in the middle of nowhere, off the beaten track and away from any form of public transport, you need to say this and clarify that unless they want to shell out half their wages on taxis each month, the candidates will need their own form of transport to join your team. Similarly, I know that you might not want to include salary specifics on the job advert itself because you dont want to deter potential candidates but Id really urge you to reconsider. You see, if the salary is an issue for a candidate, its going to be an issue whether they see it on the job advert itself or they end up discussing it with you two interviews in. Wouldnt you rather save yourself time and effort Remember, the more detail you can provide, the more successful your job advert should be in attracting the perfect candidates. 4. Choose A Relevant Job Title Remember when I said you need to inject some personality into your job ads? I didnt actually mean the job title. The job title is easily one of the most important parts of the job ad itself because it acts as the hook that draws candidates in so you need to make sure you get it right. As I mentioned in a previous blog, it can be tempting to use quirky, out there job titles, particularly in the digital sector, but Id urge you against it. Why? To put it bluntly, it can look cheesy, naff and just a bit cringe-worthy. With your job title, you need to think about the actual role itself, what the successful candidate will be doing and what experience theyll need. Hint: if youre looking for an SEO candidate with a lot of knowledge and hands-on experience, dont call the role an SEO Executive because youll just end up attracting candidates who have nowhere near enough experience. The title should accurately reflect the salary and the seniority level of the position. 5. Place The Advert On The Best Platform For The Role If youre looking for a very specific candidate with a very specific set of skills and experience, you need to carefully consider the recruitment advertising platform youre going to use. Yes, sites like Monster and Total Jobs advertise all kinds of jobs so attract job seekers from all industries but do you really want to attract job seekers from all industries? Here at Bubble weve already expressed our opinion on niche boards versus more general job boards on numerous occasions but we think weve got a point. General job boards like the ones I mentioned above definitely have their place in the market but like I said, if youre looking for a specialist candidate for a niche position, youre going to have to consider more niche boards for that sector. Remember, you want to attract the most relevant candidates and thanks to their existing audience, niche boards definitely have a better reputation for delivering quality candidates when it comes to niche roles. Definitely something to consider
